TERMS OF SERVICE

Scan-N-Go LLC Effective Date: May 1, 2026

1. Acceptance of Terms

By downloading, installing, or using the Scan-N-Go app, you agree to be bound by these Terms of Service. If you do not agree, do not use the app.

2. Description of Service

Scan-N-Go LLC provides a self-service bike and kayak rental service accessible through our mobile app. Customers scan QR codes on rental equipment, complete payment, and the equipment is unlocked via Bluetooth.

3. Eligibility

You must be at least 18 years of age to create an account and rent equipment. Minors may participate only with the consent and supervision of a parent or legal guardian who completes the rental on their behalf.

4. Account Registration

You agree to provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account.

5. Rentals and Payment

  • Rental fees are charged at the time of rental based on the package selected
  • A security hold may be placed on your payment method and released upon return of equipment
  • All fees are non-refundable unless equipment failure prevents use
  • You are responsible for the equipment during your rental period
  • Equipment must be returned in the same condition it was rented

6. Waiver and Assumption of Risk

By using our service, you acknowledge that bike and kayak activities involve inherent risks including physical injury, property damage, and death. You voluntarily assume all such risks and agree to the full waiver terms presented in the app at the time of rental.

7. Prohibited Uses

You agree not to:

  • Use the equipment for any illegal purpose
  • Damage, modify, or tamper with the equipment or locking mechanisms
  • Allow unauthorized persons to use the equipment
  • Use the equipment outside of normal operating hours or designated areas

8. Equipment Condition and Damage

You are responsible for inspecting equipment before use. By proceeding with a rental, you confirm the equipment is in acceptable condition. You will be held responsible for any damage that occurs during your rental period beyond normal wear and tear.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCAN-N-GO LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE OR RENTAL EQUIPMENT. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR YOUR MOST RECENT RENTAL.

10. Indemnification

You agree to indemnify and hold harmless Scan-N-Go LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service or violation of these Terms.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Continued use of the app after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by the laws of the State of Nebraska without regard to its conflict of law provisions.
